Terms of Use

These Terms govern access to and use of AutoTalk websites, applications, APIs, messaging integrations, AI automation, and related services. By creating an account, joining a workspace, using the API, or subscribing to a paid plan, you agree to these Terms on behalf of yourself and, when applicable, the company you represent.

1. Account Authority

You must be at least 18 years old and have authority to bind the company or organization you register. You are responsible for keeping account credentials, API keys, webhook secrets, and team access secure.

2. Service

AutoTalk provides an omnichannel AI agent platform for messaging, workflow automation, customer records, storage, APIs, webhooks, MCP access, and integrations with third-party platforms. Features may change over time as the product evolves.

3. Plans, Billing, and Overage

AutoTalk offers free and paid plans. Paid subscriptions renew automatically for the selected billing period until canceled. Usage allowances, static limits, metered pricing, currencies, and billing cycles are shown in the app and may include pay-as-you-go overage when enabled. AutoTalk may process payments directly or through a payment provider and may store payment method references when applicable.

4. Cancellation and Refunds

You may cancel a paid subscription through the billing controls available in the app or by contacting support. Cancellation normally takes effect at the end of the current billing period unless the product states otherwise. Fees are non-refundable except where required by law, for duplicate charges, or for billing errors caused by AutoTalk.

5. Customer Data and Legal Compliance

You control the data, prompts, files, contacts, messages, workflows, and records you submit to AutoTalk. You are responsible for having a lawful basis, notices, permissions, and consents for your own customers and contacts, including any sensitive or regulated data you choose to process in AutoTalk.

6. AI Features

AI output may be inaccurate, incomplete, or inappropriate for a specific use. You are responsible for configuring agents, reviewing outputs where appropriate, complying with provider rules, and deciding whether AI output can be used for your business. AutoTalk does not use customer content to train AutoTalk-owned models and does not guarantee that AI output will be error-free or fit for a regulated purpose.

7. Integrations and Third-Party Platforms

AutoTalk connects to services such as WhatsApp, Instagram, Facebook, Telegram, Discord, Twitch, AI providers, webhooks, APIs, and customer-configured systems. Your use of those integrations must comply with each provider's terms, policies, rate limits, and messaging rules. AutoTalk is not responsible for third-party outages, suspensions, policy enforcement, pricing, or data handling outside AutoTalk's control.

8. Acceptable Use

  • Do not use AutoTalk for unlawful, deceptive, abusive, spam, malware, harassment, surveillance, or rights-infringing activity.
  • Do not attempt to bypass security, quotas, billing, rate limits, authentication, tenant isolation, or platform restrictions.
  • Do not send messages without required consent or in violation of channel, anti-spam, consumer protection, or data protection rules.
  • Do not upload or transmit secrets, credentials, or regulated data unless you have the rights and safeguards required for that data.

9. Suspension and Termination

AutoTalk may suspend or restrict access if we believe there is abuse, security risk, payment failure, legal risk, platform-policy violation, or material breach of these Terms. You may stop using the service and request company deletion from the app. Deletion is subject to the retention process described in the Privacy Policy.

10. Intellectual Property

AutoTalk and its software, documentation, design, trademarks, and platform technology remain AutoTalk's property. You retain rights to your customer data and business content. You grant AutoTalk the rights needed to host, process, transmit, transform, display, and back up that content to provide the service.

11. Disclaimers and Liability

AutoTalk is provided on an as-is and as-available basis to the maximum extent allowed by law. We do not guarantee uninterrupted operation, error-free output, third-party availability, or a specific business result. To the maximum extent allowed by law, AutoTalk is not liable for indirect, incidental, special, consequential, lost profit, lost revenue, lost data, or business interruption damages.

12. Governing Law and Venue

These Terms are governed by the laws of Brazil. The parties elect the courts of Sao Paulo, State of Sao Paulo, Brazil, except where mandatory law requires a different venue.
